CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION & RETURN TERMS

GENERAL:

  1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract provided to you.
  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts (OG:27.11.2014/29188) and other applicable laws in force regarding the sale and delivery of the purchased product.
  3. The shipping costs for product delivery will be borne by the buyers.
  4. Each purchased product shall be delivered to the buyer or the person/organization at the address indicated by the buyer within 30 days at most, unless otherwise specified. If the product is not delivered within this period, buyers may terminate the contract.
  5. The purchased product must be delivered fully and in accordance with the characteristics specified in the order, and accompanied by documents such as a warranty certificate and user manual, if available.
  6. If the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days of learning about it. The total amount must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT FEE IS NOT PAID:

  1. If the buyer does not pay the fee for the purchased product or cancels it in the bank records, the seller’s obligation to deliver the product ceases.

SHOPPING MADE USING UNAUTHORIZED USE OF A CREDIT CARD:

  1. If it is determined that the credit card used by the buyer for payment was unlawfully used by unauthorized persons after the product has been delivered, and the product fee is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with the shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN CIRCUMSTANCES:

  1. If unforeseen circumstances prevent the timely delivery of the product, the seller will inform the buyer of the situation. The buyer may request the cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is resolved. If the buyer cancels the order, the payment will be refunded in cash within 14 days if made in cash. If the payment was made by credit card and the order is canceled, the product fee will be refunded to the bank within 14 days, but it may take 2-3 weeks for the bank to transfer it to the buyer’s account.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

  1. The buyer must inspect the goods/services subject to the contract before accepting delivery; they must not accept damaged, defective, or visibly compromised goods/services (e.g., crushed, broken, torn packaging). Once the goods/services are accepted, they are considered to be undamaged and intact. After delivery, the buyer must carefully protect the goods/services. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The buyer may use their right of withdrawal from the contract, without assuming any legal or penal liability, and without providing any reason, by refusing the goods within 14 (fourteen) days from the delivery of the purchased product to themselves or the designated person/organization. This must be done by notifying the seller through the contact information provided below.

WITHDRAWAL PERIOD:

  1. If the purchased item is a service, this 14-day period starts from the date of the contract. The right of withdrawal cannot be exercised for service contracts where service provision has started with the consumer’s approval before the withdrawal period expires.
  2. Costs associated with the exercise of the right of withdrawal are borne by the seller.
  3. To exercise the right of withdrawal, a written notification must be sent to the seller via registered mail, fax, or email within 14 (fourteen) days, and the product must not have been used as per the terms outlined in the “Products for Which the Right of Withdrawal Cannot Be Exercised” section of this contract.

EXERCISING THE RIGHT OF WITHDRAWAL:

  1. The invoice for the product delivered to the third party or the buyer must be returned (if the returned product was invoiced to a corporate entity, a return invoice issued by the corporation must be included. Refunds for orders invoiced to corporate entities cannot be processed without a return invoice).
  2. The return form, along with the product’s box, packaging, and any standard accessories, must be returned completely and undamaged.

RETURN TERMS:

  1. The seller is obligated to refund the total amount and return any documents that put the buyer under obligation within 10 days from receiving the withdrawal notification and to accept the return of the product within 20 days.
  2. If the value of the product decreases due to a fault of the buyer or if the return becomes impossible, the buyer is liable to compensate the seller’s losses proportionally to their fault. However, the buyer is not responsible for changes or deterioration caused by the proper use of the product or goods within the withdrawal period.
  3. If the use of the right of withdrawal causes the campaign limit amount set by the seller to be exceeded, the amount of the discount enjoyed under the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. Products prepared in line with the buyer’s wishes or clearly tailored to personal needs, products unsuitable for return due to health or hygiene reasons once their packaging has been opened by the buyer (e.g., underwear, swimsuits, bikini bottoms, cosmetics, perishable goods, or items nearing their expiration date), products mixed inseparably with other items after delivery, periodicals such as newspapers and magazines (excluding subscription agreements), digitally delivered services or intangible goods delivered instantly to the consumer, and products like books, digital content, software programs, data storage devices, and computer consumables cannot be returned if their packaging is opened by the buyer. Additionally, the right of withdrawal cannot be exercised for services whose provision has started with the consumer’s consent before the withdrawal period expires.
  2. Cosmetic and personal care products, underwear, swimwear, bikinis, books, software and programs that can be copied, DVDs, VCDs, CDs, and cassettes, as well as stationery supplies (e.g., toners, cartridges, ribbons), can only be returned if their packaging is unopened, unused, untested, undamaged, and intact.

DEFAULT AND LEGAL CONSEQUENCES:

  1. If the buyer defaults on a credit card payment, they accept, declare, and undertake that they will pay interest under the credit card agreement with their bank and be liable to the bank. In such cases, the bank may take legal action and demand all legal expenses and attorney fees from the buyer. In any case, the buyer agrees to compensate the seller for damages caused by the delay in fulfilling the debt.
